The Department of Government Efficiency (DOGE), a controversial initiative tied to Elon Musk, is under intense legal scrutiny. In a single day, three lawsuits were filed in federal court in Washington, alleging DOGE’s operations violate the Federal Advisory Committee Act (FACA), according to the reports.
It requires the government’s advisory committees to conduct open meetings and draft formal charters—supposedly ignored in this instance, per DOGE. The lawsuits, which come from watchdog groups and labor unions, alleged DOGE operates without approval from Congress and is unaccountable.
Critics counter the initiative’s mission of slashing federal regulations and shrinking the government workforce has broad-reaching ramifications for public health, consumer safety, and financial protection. They say DOGE, formatted as a “department,” does not have any legal standing as such since any creation of federal departments needs to come by legislation from Congress.
DOGE’s Operations and Secrecy Concerns
The legal petitions also single out individuals, such as Elon Musk and Vivek Ramaswamy, along with former US President Donald Trump. In fact, the accusations against the agency are that this organization is headed by insiders in Silicon Valley and runs under encrypted messaging services like Signal, thus not being transparent about its operations and lacking proper scrutiny.
Ramaswamy, steped down to pursue political ambitions, has been a central figure in DOGE’s operations. Reports suggest he and Musk have been busy assembling teams and securing office space, potentially within the federal Office of Management and Budget.
The lawsuits claim that the agency is not merely offering advice but is influencing significant decisions without public deliberation or transparent processes. The allegations go further, stating that the agency’s activities include recommendations to reduce the federal workforce. This, critics argue, involves unelected billionaires making consequential decisions that should be subject to public and Congressional scrutiny.
Musk’s Role and Wider Implications
Their timing coincided with the fact that Musk attended the inauguration of Donald Trump as President, milled around, and mingled with other billionaires. The same event featured a discussion by Trump on ambitious projects regarding sending astronauts on Mars, turning the spotlight towards the agency’s controversial mission.
The lawsuits want to make it clear whether or not DOGE constitutes an advisory committee under the FACA definition and, therefore, is subject to the specific legal requirements of such a committee on transparency and accountability. Watchdog groups say that in its current operation, DOGE bypasses the requirements of that law and would set a very bad precedent for other similar projects.
